Article 2. Applicability
These terms and conditions apply to every offer from Tea & Tales and to every distance contract made between Tea & Tales and a consumer.
By placing an order through our webshop you agree to these terms and conditions.
If at any moment one or more provisions in these terms are wholly or partly void or are annulled, the remaining provisions continue to apply in full.
Article 3. The offer
We take great care in putting together our webshop and in describing our products as fully and accurately as possible. Obvious slips, errors or mistakes in the offer do not bind Tea & Tales.
Images, colours, atmospheric photos and product descriptions are meant to give the best possible impression of the product. Small differences in colour, packaging or presentation can occur.
The offer contains a full and accurate description of the products on offer, as far as that is reasonably possible.
Article 4. The contract
The contract is made at the moment you place an order and Tea & Tales confirms this order by e-mail.
Tea & Tales reserves the right to refuse an order or to attach additional conditions to an order, for example in the case of incorrect details, a suspicion of misuse or problems with payment.
Article 5. Prices
All prices on the website are given in euros and include VAT, unless stated otherwise. Any shipping costs are clearly stated before you complete your order.
Tea & Tales reserves the right to adjust prices at any time. The price that applies at the moment of ordering is the price that applies to the contract.
Obvious pricing errors or obvious slips do not bind Tea & Tales.
Article 6. Payment
Payment is made through the payment methods offered in the webshop.
Tea & Tales may only process an order after the payment has been received successfully, unless expressly agreed otherwise.
Article 7. Delivery and performance
Tea & Tales will process and send orders with the greatest possible care.
Orders are delivered to the address you have given. The delivery times given are an indication. Exceeding a stated delivery time does not automatically give a right to compensation or cancellation, unless the delay is such that you cannot reasonably be expected to keep the contract in place.
The risk of damage to or loss of products stays with Tea & Tales until the moment of delivery to you or to a third party appointed by you, unless expressly agreed otherwise.
Article 8. Right of withdrawal
When buying products through the webshop you have the right, as a consumer, to cancel the contract without giving reasons within 14 days of receiving the product.
During this cooling-off period you should handle the product and the packaging carefully. You may only unpack or use the product as far as is needed to establish the nature, characteristics and working of the product.
If you want to use the right of withdrawal, you can register this within the cooling-off period only through the return form on our website or through the WhatsApp Business button, which is at the bottom left of every page.
After cancelling you should send the product back to us as soon as possible, and at the latest within 14 days of your notice of withdrawal.
We refund the full purchase amount, including the standard shipping costs of the original delivery, within 14 days of your notice of withdrawal. We may wait with the refund until we have received the product or until you have shown that you have sent the product back, whichever comes first.
The direct cost of sending the product back is at your expense, unless stated otherwise. Items should be returned in original and undamaged condition.
Article 9. Exceptions to the right of withdrawal
The right of withdrawal does not apply to sealed tea, matcha and other food products which, for reasons of health protection and hygiene, are not suitable to be sent back once the seal has been broken after delivery. In that case the product cannot be returned or refunded.
Books and unopened, sealed products can be returned within the statutory cooling-off period, provided they are unused and, as far as reasonably possible, are sent back in their original condition.
Article 10. Conformity and complaints
Tea & Tales guarantees that the products meet the contract, the specifications stated in the offer and the reasonable requirements of soundness and usability.
If a product does not meet what you could reasonably expect, please get in touch with us as soon as possible at webshop@teatales.nl.
Complaints about the performance of the contract must be submitted fully and clearly described within a reasonable period after you have discovered the fault.
We aim to answer complaints within 14 days of receiving them.
Article 11. Use of the website
All intellectual property rights relating to the website, texts, images, logos, product descriptions and other content belong to Tea & Tales or its licensors.
It is not permitted to copy, distribute, publish or otherwise use material from the website without prior written permission, except for personal and non-commercial use.
Article 12. Liability
Tea & Tales is not liable for indirect damage, consequential damage, lost profit or other damage arising from the use of the website or of the products bought, except as far as this may not be excluded under mandatory law.
Nothing in these terms limits the statutory rights of consumers or excludes liability as far as that is not permitted under Dutch or European law.
Article 13. Privacy
Our privacy policy applies to the processing of personal data. This privacy policy is available on our website.
Article 14. Force majeure
Tea & Tales is not obliged to meet any obligation if it is prevented from doing so by force majeure. Force majeure means any circumstance beyond our will because of which meeting obligations cannot reasonably be expected of us.
Article 15. Applicable law and disputes
All agreements between Tea & Tales and the consumer are governed exclusively by Dutch law.
Disputes are submitted exclusively to the competent court of the District Court of Rotterdam (Rechtbank Rotterdam), the court in the region where Tea & Tales is established.
Article 16. Language
These terms and conditions are drawn up in Dutch. In case of any difference between a translation and the Dutch text, the Dutch text prevails.
