Article 2 - Applicability
These terms and conditions apply to every offer made by Tea & Tales and to every distance contract concluded between Tea & Tales and a consumer.
By placing an order through our webshop, you agree to these terms and conditions.
If one or more provisions of these terms and conditions are at any time wholly or partly void or annulled, the remaining provisions remain fully applicable.
Article 3 - The offer
We take great care in putting together our webshop and in describing our products as fully and accurately as possible. Obvious mistakes, errors or slips of the pen in the offer are not binding on Tea & Tales.
Images, colours, styled photographs and product descriptions are intended to give the best possible impression of the product. Minor variations in colour, packaging or presentation may occur.
The offer contains a complete and accurate description of the products offered, in so far as this is reasonably possible.
Article 4 - The contract
The contract is concluded at the moment you place an order and Tea & Tales confirms that order by email.
Tea & Tales reserves the right to refuse an order or to attach additional conditions to an order, for example in the case of incorrect details, a suspicion of misuse or problems with payment.
Article 5 - Prices
All prices on the website are stated in euros and include VAT, unless indicated otherwise. Any shipping costs are clearly stated before you complete your order.
Tea & Tales reserves the right to adjust prices at any time. The price that applies at the moment of ordering is the price that applies to the contract.
Obvious pricing errors or obvious mistakes are not binding on Tea & Tales.
Article 6 - Payment
Payment is made using the payment methods offered in the webshop.
Tea & Tales may only process an order after payment has been successfully received, unless expressly agreed otherwise.
Article 7 - Delivery and performance
Tea & Tales will process and dispatch orders with the greatest possible care.
Orders are delivered to the address you have provided. Stated delivery times are indicative. Exceeding a stated delivery time does not automatically give rise to a right to compensation or to rescission, unless the delay is such that you cannot reasonably be expected to uphold the contract.
The risk of damage to or loss of products remains with Tea & Tales until the moment of delivery to you or to a third party designated by you, unless expressly agreed otherwise.
Article 8 - Right of withdrawal
When you purchase products through the webshop, you have the right as a consumer to rescind the contract without giving reasons within 14 days of receiving the product.
During this cooling off period you must handle the product and its packaging with care. You may only unpack or use the product to the extent necessary to establish the nature, characteristics and functioning of the product.
How to register a return
If you wish to exercise your right of withdrawal, notify us within the cooling off period in one of the following ways:
- through the returns form on our website;
- through the WhatsApp Business button at the bottom left of every page.
Return requests are handled exclusively through these two routes. Registering a return by email is not possible. If you wish to use the statutory model form, you will find it at EU withdrawal form.
After rescission you must return the product to us as soon as possible, and no later than 14 days after you notify us of your withdrawal.
We will refund the full purchase amount, including the standard shipping costs of the original delivery, within 14 days of your withdrawal notification. We may withhold the refund until we have received the product or until you have demonstrated that you have returned the product, whichever is the earlier.
The direct costs of returning the product are at your expense, unless stated otherwise.
Article 9 - Exceptions to the right of withdrawal
The right of withdrawal does not apply to sealed tea, matcha and other food products which, for reasons of health protection and hygiene, are not suitable for return, where the seal has been broken after delivery. In that case the product cannot be returned or refunded. This is in line with the EU exception for sealed goods that are not suitable for return after opening for reasons of health protection or hygiene.
Books, unopened sealed products and gift items may be returned within the statutory cooling off period, provided they are unused and, in so far as reasonably possible, are returned in their original condition.
Article 10 - Conformity and complaints
Tea & Tales warrants that the products comply with the contract, with the specifications stated in the offer and with the reasonable requirements of soundness and usability.
If a product does not meet what you could reasonably expect, please contact us as soon as possible at webshop@teatales.nl.
Complaints about the performance of the contract must be submitted fully and clearly described within a reasonable period after you have discovered the defect.
We aim to respond to complaints within 14 days of receipt.
Article 11 - Use of the website
All intellectual property rights relating to the website, texts, images, logos, product descriptions and other content belong to Tea & Tales or its licensors.
Without prior written permission, you may not copy, distribute, publish or otherwise use material from the website, except for personal and non-commercial use.
Article 12 - Liability
Tea & Tales is not liable for indirect damage, consequential loss, loss of profit or other damage arising from the use of the website or of the products purchased, except in so far as this may not be excluded under mandatory law.
Nothing in these terms and conditions limits the statutory rights of consumers or excludes liability in so far as this is not permitted under Dutch or European law.
Article 13 - Privacy
Our privacy policy applies to the processing of personal data. This privacy policy is available on our website.
Article 14 - Force majeure
Tea & Tales is not obliged to fulfil any obligation if it is prevented from doing so by force majeure. Force majeure means any circumstance beyond our control as a result of which fulfilment of obligations cannot reasonably be required of us.
Article 15 - Applicable law and disputes
All contracts between Tea & Tales and the consumer are governed exclusively by Dutch law.
Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.
